Your privacy is very important to us. You have in great detail the ability to set your privacy and what information you want to disclose in your profile.
2. Sharing Your Content and Information
You own all of the content and information you post on MyBucketListing, and you can control how it is shared through your privacy and application settings. In addition:
For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the permission to use the IP content on our site, subject to your privacy and application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with MyBucketListing (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
After you deleted your IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. You understand that removed content may still exist in backup copies for a reasonable period of time, without being available to others.
When you publish content using the Public setting, you are allowing everyone, including people off of MyBucketListing, to access and use that information, and to associate it with you (i.e., your name and profile picture).
3. Information Safety
We strive to keep MyBucketListing safe, but we cannot guarantee it. We need your help to keep MyBucketListing safe, which includes the following obligations by you:
You will not solicit login information or access an account belonging to someone else.
You will not use harvesting bots, robots, spiders, or scrapers to collect user content and information, on my MyBucketListing.
You will not upload viruses or other malicious code.
You will not post unauthorized commercial communications and spam on MyBucketListing.
You will not harass or bully other users.
You will not post content against our user policy, such as hate speech, or pornographic matters, or contains nudity or graphic violence.
You will not post content that are alcohol-related or dating content, including advertisements.
You will not use MyBucketListing to do anything unlawful, malicious, or discriminatory.
You will not do anything that could disable, overburden, or impair the proper working or appearance of MyBucketListing, such as a denial of service attack or interference with page rendering or other MyBucketListing functionality.
You will not facilitate or encourage any violations of this Statement or our policies.
4. Registration and Account Security
MyBucketListing users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:
You will not provide any false personal information on MyBucketListing, or create an account for anyone other than yourself without permission.
You will not create more than one personal account.
If we disable your account, you will not create another one without our permission.
You will not use MyBucketListing if you are under the age of 13.
You will not use MyBucketListing if you are a convicted sex offender.
You will keep your contact information up-to-date.
You will not share your password or do anything else that might compromise the security of your account.
We reserve the right to remove or reclaim your account if we deem it appropriate. For example when a trademark owner complains about a username that does infringe on our policy.
5. Protecting Other People's Rights
We require you to respect other people's rights.
You will not post content on MyBucketListing that violates someone else's privacy or rights or violates the law.
We can remove at any time any content or information you post on MyBucketListing if we think that it violates our policies.
If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, you will be provided with an opportunity to appeal.
If you repeatedly violate other people's intellectual property rights, we will disable your account.
You will not use our copyrights or trademarks (including MyBucketListing, the MyBucketListing and MB Logos), or any confusingly similar marks, except as expressly permitted with our prior written permission.
You will not post anyone's identification documents or sensitive financial information on MyBucketListing.
6. Mobile and Other Devices
We currently provide our mobile services for free, but please be aware that your carrier's normal rates and fees, such as text messaging and data charges still apply.
You provide consent and all rights necessary to enable users to sync their devices with any information that is visible to them on MyBucketListing.
7. Special Provisions Applicable to Social Plugins
If you include our Social Plugins, such as the Share or Like buttons on your website, the following additional terms apply to you:
We give you permission to use MyBucketListing's Social Plugins so that users can post links or content from your website on MyBucketListing.
You give us permission to use and allow others to use such links and content on MyBucketListing.
You will not place a Social Plugin on any page containing content that would violate this Statement if posted on MyBucketListing.
8. Advertisements and Commercial Content Served or Enhanced by MyBucketListing
To deliver advertising and other commercial or sponsored content that is valuable to our users and advertisers we need your help. In order to accomplish this goal, you agree to the following:
You give us permission to use your name, profile picture, content, and information in connection with commercial, sponsored, or related content, such as a brand you like, displayed or enhanced by us. This means, that you permit a business or other entity to pay us to display your name and/or profile picture with your content or information, without any compensation to you. If you have chosen a specific audience for your content or information, we will respect your choice when we use it.
We do not offer your content or information to advertisers without your consent.
9. Provisions Applicable to Advertisers
You can target your desired audience by buying ads on our MyBucketListing network. The following additional terms apply to you if you place an order through our online advertising portal:
Once you place an Order, you decide which type of advertising you want to buy and the amount you want to spend. If we accept your Order, we will deliver your ads as they become available. We try our best to deliver the ads to your specified audience, although we cannot guarantee your ad will reach its aimed target.
Your ads must comply with our Advertising Guidelines.
We will determine the size, placement, and positioning of your ads.
We do not guarantee the number of clicks your ads will get.
You may cancel your Order at any time through our online portal, yet it may take up to 24 hours before the ad stops running. You are responsible for paying for all ads that run.
Our license to run your ad ends with the completion of your Order. You understand, that if users have interacted with your ad, your ad may remain until the users delete it.
You grant us the right to use your ads and related content and information for marketing purposes.
You will not issue any press release or make public statements about your relationship with MyBucketListing without our prior written permission.
We may reject or remove any ad for any reason.
You will resolve any claim, cause of action or dispute you have with us arising out of or relating to this Statement or MyBucketListing exclusively in the U.S. District Court for the State of Arizona, and you agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims. The laws of the State of Arizona will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions.
If anyone brings a claim against us related to your actions, content or information on MyBucketListing, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users' actions on MyBucketListing and are not responsible for the content or information users transmit or share on MyBucketListing. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on MyBucketListing. We are not responsible for the conduct, whether online or offline, or any user of MyBucketListing.
12. Provisions Applicable to Users Outside the United States
Our goal is to create a global community with an equal standard for everyone. We also strive to respect local laws as well. The following stipulations apply to users and non-users who interact with MyBucketListing outside the United States:
You consent to having your personal data transferred to and processed in the United States.
If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on MyBucketListing (such as advertising or payments) or operate a Platform application or website. You will not use MyBucketListing if you are prohibited from receiving products, services, or software originating from the United States.
14. Certain specific terms that apply only for German users are available below.

Ziffer 2 gilt mit der Maßgabe, dass unsere Nutzung dieser Inhalte auf die Verwendung auf oder in Verbindung mit MyBucketListing beschränkt ist.
Ziffer 9 wird ersetzt durch: Unser Ziel ist es Werbeanzeigen nicht nur für Werbetreibende sondern auch für die Nutzer wertvoll zu gestalten. Damit dies möglich ist, erklärst du dich mit Folgendem einverstanden:
Du erteilst uns die Erlaubnis, sofern du in den Privatsphäre-Einstellungen nichts anderes festgelegt hast, deinen Namen und dein Profilbild für kommerzielle, gesponserte oder verwandte Inhalte (wie z. B. einer Marke, die dir gefällt), die von uns zur Verfügung gestellt oder gestaltet werden, einzusetzen.
Wir werden Änderungen nur vornehmen, wenn die Regelungen dort nicht mehr passen oder wenn sie sich als unvollständig herausstellen, und wenn diese Änderungen unter Berücksichtigung deiner Interessen für dich zumutbar sind.
Unser Recht zur außerordentlichen Kündigung aus wichtigem Grund bleibt unberührt. Ein wichtiger Grund liegt insbesondere vor, wenn eine Partei gegen Verpflichtungen aus dieser Erklärung, gegen gesetzliche Vorschriften, Rechte Dritter oder die Datenschutzrichtlinien verstößt, und der kündigenden Partei unter Berücksichtigung aller Umstände des Einzelfalls und unter Abwägung der beiderseitigen Interessen die Fortsetzung des Vertragsverhältnisses bis zur vereinbarten Beendigung oder bis zum Ablauf einer Kündigungsfrist nicht zugemutet werden kann. Eine Kündigung aus wichtigem Grund ist nur innerhalb einer angemessenen Frist nach Kenntniserlangung möglich.
Besteht der wichtige Grund in der Verletzung einer Pflicht aus dieser Erklärung, ist die Kündigung erst nach erfolglosem Ablauf einer zur Abhilfe bestimmten Pflicht oder nach erfolgloser Abmahnung zulässig. Einer Abhilfefrist bedarf es jedoch nicht, wenn die andere Seite die Erfüllung ihrer Verpflichtungen ernsthaft und endgültig verweigert oder besondere Umstände vorliegen, die unter Abwägung der beiderseitigen Interessen eine sofortige Kündigung rechtfertigen.
Diese Erklärung unterliegt deutschem Recht.
